Public Offer Agreement

This Public Offer Agreement (“Agreement”) is issued by TEND BUSINESS GROUP LTD (trading as IT-Promotion.net), hereinafter referred to as the “Contractor”, and defines the terms and conditions for the provision of digital products and services.

1. General Provisions

This Agreement is a public offer published on the website it-promotion.net, operated by the Contractor.

By making a payment for any product or service, the Customer confirms full acceptance of this Agreement and enters into a binding contract with the Contractor.

This Agreement does not require a handwritten signature and is accepted electronically at the moment of purchase.

2. Subject of the Agreement

Under this Agreement, the Contractor provides the Customer with access to digital products and/or services after successful payment.

3. Rights and Obligations of the Contractor

The Contractor undertakes to:

  • Provide access to purchased digital products or services
  • Use Customer data only for service delivery and support
  • Provide reasonable technical or informational support related to the purchased product

The Contractor has the right to:

  • Determine pricing and modify service conditions at any time
  • Define the scope and method of service delivery
  • Suspend services in case of non-payment or violation of terms

4. Rights and Obligations of the Customer

The Customer undertakes to:

  • Provide accurate information necessary for service delivery
  • Pay for services in full and on time
  • Not disclose confidential information received from the Contractor

The Customer has the right to:

  • Receive access to purchased products or services
  • Request support related to the purchased services

5. Digital Products and License

Digital products may include, but are not limited to:

  • Web design and development templates
  • Mobile and web application templates
  • E-commerce solutions
  • Marketing tools and packages
  • Plugins, scripts, and extensions

Unless otherwise stated:

  • Standard license allows use in one project (personal or commercial)
  • Extended license allows use in multiple projects
  • Resale of products “as-is” is prohibited

6. Pricing and Payment

All prices are determined by the Contractor and are displayed on the website.

Payment is required in full prior to delivery of digital products or services.

7. Refund Policy

Refunds are governed by the Refund Policy available on the website.

By purchasing, the Customer agrees that digital products are delivered electronically and acknowledges that certain statutory withdrawal rights may be waived after access begins, in accordance with applicable EU consumer law.

8. Liability and Warranties

The Contractor provides services and digital products “as is” and does not guarantee compatibility with all third-party systems unless explicitly stated.

The Contractor is not responsible for misuse of products or incompatibility with external software not listed as supported.

9. Confidentiality

Both parties agree to keep all confidential information private and not disclose it to third parties unless required by law.

This obligation remains valid after termination of the Agreement.

10. Termination

The Customer may stop using the services at any time. Access to digital products is governed by the terms of purchase and applicable license conditions.

11. Final Provisions

The Customer confirms that:

  • They have read and understood this Agreement
  • They accept all terms voluntarily
  • They have legal capacity to enter into this Agreement
